A county court judgement begins when money is owed to a creditor and they take a County Court action against you to claim the money. If the outstanding money is paid back to the creditor, a hearing or a county court judgement can be avoided.
If the money is not paid, the court requires that you send them the information, so that they can decide whether you owe any money and how it should be repaid. This is completed using a County Court Claim form. The form shows how much money the creditor is demanding and the details of the claim, and allows the opportunity of explaining the situation to the court.
An admission form is also sent with the claim form to detail your incomings and outgoings that reflect the current circumstances. This must be sent back to the court with an offer to repay the debt.
If your offer is accepted by the court, they issue a county court judgement with details of when and how to pay. If an offer isn't made, the court will still issue a county court judgement and demand that the full amount is paid or monthly payments are set up.
Unless the full amount of the judgment is paid off within one month, the CCJs are recorded on the Register of County Court Judgements for six years.
The only way to get he judgement removed from this register is:
If the amount due to repaid is paid back in full more than a month after the county court judgement was issued, the CCJ stays on the Register for full six years. It is marked as 'satisfied', and anyone searching on the Register will see that the judgement has been paid and the date that it was paid back.
If the amount due to be repaid is not paid back in full, the CCJ is marked as 'unsatisfied'.
Entries on the Register can only be removed by the court, and the circumstances for this are rare. The County Court Judgement can only be set aside if it was wrong at the time it was entered or matched to the wrong person or company. In this case the judgement can be cancelled and if requested to court will offer proof that this is the case.
The Registry Trust passes all information on County Court Judgements to the credit reference agencies. Purchasing a full credit report from checkSURE will provide details of CCJ's on companies and businesses. The report will include:
